Statutory declaration

The statutory declaration (formerly oath of disclosure) of a debtor gives the creditor an overview of his debtor’s actual assets. The statutory declaration can be applied only if an unsuccessful enforcement of creditor’s claim has already occurred once or if a debtor has refused to allow a search of his premises. The debtor submits the statutory declaration either directly to the bailiff or is summoned by the latter to issue the statutory declaration.
