    Data processing is carried out for the purposes of initiating a contract as well as the fulfilment of the contract in accordance with Art. 6 I (b) of the GDPR.

    We process the following categories of data: Master data, address data, communication data and contract data. The data from these categories was either supplied to us by you or acquired from publicly available data sources.

    Recipients:
    We just disclose your data to another company of the EOS Group or another third party (recipient), if

    • we are required to do so by law, because it is necessary to process your data for the purposes of fulfilling a contract with you,
    • in accordance with Art. 6 I (f) of the GDPR the transfer is necessary for the assertion, exercise or defence of legal claims and there is no reason to believe that the data subject´s rights are compromised thereby,
    • there is a legal obligation for the transfer of the data in accordance with Art 6 I (c) of the GDPR,
    • you have expressly consented to the further use of your date in accordance with Art. 6 I (a) of the GDPR or
    • the data will be processed by a processor in accordance with Art. 28 of the GDPR.

    Your personal data will not be passed to third parties for other purposes than those specified above.

    Duration of storage:
    One of the reasons that we store your data is for the purposes of fulfilling the contract. If the erasure of data is requested, or permission to process the data is revoked, an assessment is performed regarding whether there is a lack of legal basis and what the purposes for storage are. If there is neither a legal basis/purpose for storage, the data is erased immediately.

    There is no requirement to erase data if the data relates to a legal entity or is public available.

    Rights of the data subject:
    In accordance with Art. 15–22 of the GDPR, you have the following rights if the legal requirements are applicable: Right of access, rectification, erasure, restriction of processing and data portability.  

    Right to lodge a complaint to the supervisory authority:
    In accordance with Art. 77 of the GDPR, you have the right to lodge a complaint to the supervisory authority. If you wish to lodge a complaint, you can usually contact the supervisory authority for your habitual residence or place of work, or the supervisory authority for our company headquarters.

Another purpose for data processing is for targeted advertising purposes relating to services within the framework of receivables management in accordance with Art. 6 1. (f) of the GDPR.     On the website of EOS Deutschland GmbH we offer you the opportunity to subscribe to our newsletter. To make sure that no errors have occurred when entering your email address, we use the double opt-in process (DOI process): This means that after you have entered your email address into the registration field and given your consent to receive our newsletter, we will send a confirmation link to the email address you gave us. Only after you have clicked on the confirmation link will your email address be added to our circulation list for receipt of our newsletter. The lawful basis for the processing of the data is Article 6 Para. 1 Sub-section (a) GDPR.

    We process the following categories of data: master data, contact details. You have sent us data from the above data categories.

    Recipients:
    We will only share your personal data with other companies of the EOS Group or other third parties (recipients) if:

    • we have a legal obligation to do so pursuant to Article 6 I (c) GDPR, and
    • you have given your express consent for one or more of the intended purposes in accordance with Article 6 I (a) GDPR,
    • we have engaged another party to manage the data in compliance with Article 28 GDPR.

    Duration of storage:
    If you ask for your data to be deleted or withdraw your consent, we examine whether the lawful basis and purpose of the storage cease to apply. If there is no lawful basis/purpose for the storage the data will be deleted immediately.

    Rights of the individual affected:
    If the statutory requirements are met, you are entitled to the following rights pursuant to Articles 15 to 20 GDPR: Rights of access, rectification, erasure, restriction of processing and to data portability.

    Insofar as we process data based on consent you have given, you have the right to withdraw your consent at any time in accordance with Article 7 Para. 3 GDPR. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
